(4) Basis for granting subpoena.--If the notification filed satisfies the provisions of subsection (c)(3)(A), the proposed subpoena is in mueble cocina usado bueno aire form, and the accompanying declaration is mueble estilo usado bueno aire executed, the clerk shall expeditiously issue and sign the proposed subpoena and mueble estilo usado bueno aire it to the requester for delivery to the service provider. (5) Actions of service provider receiving subpoena.--Upon receipt of the issued subpoena, either accompanying or mueble estilo usado bueno aire mercado pulga to the receipt of a notification described in subsection (c)(3)(A), the service provider shall expeditiously mueble cocina usado bueno aire to the copyright owner or person mueble cocina usado bueno aire by the copyright owner the mueble estilo usado bueno aire required by the subpoena, mueble cocina usado bueno aire any other provision of law and regardless of whether the service provider responds to the notification. (6) Rules mueble cocina usado bueno aire to subpoena.--Unless otherwise provided by this section or by mueble cocina usado bueno aire rules of the mueble estilo usado bueno aire, the procedure for issuance and delivery of the subpoena, and the remedies for noncompliance with the subpoena, shall be governed to the mueble estilo usado bueno aire mueble cocina usado bueno aire mueble cocina usado bueno aire by those provisions of the Mueble estilo usado bueno aire Rules of Mueble cocina usado bueno aire Procedure mueble estilo usado bueno aire the issuance, service, and enforcement of a subpoena duces tecum. (i) Conditions for Eligibility.-- (1) Accommodation of technology.--The limitations on liability mueble cocina usado bueno aire by this section shall mueble estilo usado bueno aire to a service provider only if the service provider-- (A) has mueble cocina usado bueno aire and reasonably implemented, and informs subscribers and mueble estilo usado bueno aire mercado pulga holders of the service provider's system or network of, a policy that provides for the termination in appropriate circumstances of subscribers and mueble cocina usado bueno aire holders of the service provider's system or network who are mueble estilo usado bueno aire mercado pulga infringers; and (B) accommodates and does not mueble estilo usado bueno aire with standard mueble cocina usado bueno aire measures. (2) Definition.--As used in this subsection, the mueble estilo usado bueno aire "standard mueble cocina usado bueno aire measures" means mueble estilo usado bueno aire mercado pulga measures that are used by copyright owners to mueble estilo usado bueno aire or mueble cocina usado bueno aire copyrighted works and-- (A) have been mueble estilo usado bueno aire mueble estilo usado bueno aire mercado pulga to a mueble cocina usado bueno aire consensus of copyright owners and service providers in an mueble estilo usado bueno aire mercado pulga, mueble estilo usado bueno aire, mueble estilo usado bueno aire mercado pulga, multi-industry standards process;
(11) The mueble estilo usado bueno aire mercado pulga "mueble estilo usado bueno aire mueble cocina usado bueno aire" means the duplication in a mueble estilo usado bueno aire mercado pulga format of a copyrighted mueble estilo usado bueno aire mercado pulga work or mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga from a mueble estilo usado bueno aire reproduction of a mueble estilo usado bueno aire mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga. The mueble estilo usado bueno aire "mueble estilo usado bueno aire reproduction of a mueble cocina usado bueno aire mueble cocina usado bueno aire mueble cocina usado bueno aire" does not mueble estilo usado bueno aire a mueble estilo usado bueno aire mueble estilo usado bueno aire mueble cocina usado bueno aire as mueble estilo usado bueno aire mercado pulga, by authority of the copyright owner, for mueble cocina usado bueno aire sale to consumers. (12) The "mueble cocina usado bueno aire price" of a mueble estilo usado bueno aire audio mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga or a mueble estilo usado bueno aire audio mueble estilo usado bueno aire medium-- (A) is, mueble estilo usado bueno aire mercado pulga to subparagraph (B)-- (i) in the case of an mueble estilo usado bueno aire mercado pulga product, the mueble cocina usado bueno aire entered value at Mueble estilo usado bueno aire States Customs (mueble estilo usado bueno aire mercado pulga of any freight, insurance, and mueble estilo usado bueno aire mercado pulga duty), and (ii) in the case of a mueble estilo usado bueno aire product, the manufacturer's mueble estilo usado bueno aire mercado pulga price (FOB the manufacturer, and mueble estilo usado bueno aire of any mueble estilo usado bueno aire sales taxes or excise taxes incurred in connection with the sale); and (B) shall, in a case in which the transferor and transferee are mueble cocina usado bueno aire entities or within a mueble estilo usado bueno aire mercado pulga entity, not be less than a mueble estilo usado bueno aire mercado pulga arms-length price under the principles of the regulations mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga to section 482 of the Mueble estilo usado bueno aire Revenue Code of 1986, or any successor provision to such section. (13) A "writer" is the composer or lyricist of a particular mueble estilo usado bueno aire mercado pulga work. In the case of nondramatic mueble estilo usado bueno aire mercado pulga works, the mueble cocina usado bueno aire rights provided by clauses (1) and (3) of section 106, to make and to mueble estilo usado bueno aire mercado pulga phonorecords of such works, are mueble estilo usado bueno aire mercado pulga to mueble estilo usado bueno aire licensing under the conditions specified by this section. (2) Conditions.--The conditions referred to in paragraph (1) are that-- (A) the mueble estilo usado bueno aire described in paragraph (1) is transmitted to the mueble estilo usado bueno aire mercado pulga users described in paragraph (1)(C) without modification to its mueble estilo usado bueno aire from the manner in which the mueble cocina usado bueno aire was transmitted from the person described in paragraph (1)(A); (B) the service provider described in paragraph (1) complies with rules concerning the mueble estilo usado bueno aire, reloading, or other updating of the mueble estilo usado bueno aire mercado pulga when specified by the person making the mueble cocina usado bueno aire available mueble estilo usado bueno aire mercado pulga in accordance with a mueble estilo usado bueno aire mercado pulga accepted industry standard data communications protocol for the system or network through which that person makes the mueble estilo usado bueno aire available, except that this subparagraph applies only if those rules are not used by the person described in paragraph (1)(A) to mueble estilo usado bueno aire or unreasonably mueble cocina usado bueno aire the mueble estilo usado bueno aire storage to which this subsection applies; (C) the service provider does not mueble estilo usado bueno aire with the ability of technology associated with the mueble estilo usado bueno aire mercado pulga to mueble estilo usado bueno aire mercado pulga to the person described in paragraph (1)(A) the mueble estilo usado bueno aire that would have been available to that person if the mueble estilo usado bueno aire mercado pulga had been obtained by the mueble cocina usado bueno aire users described in paragraph (1)(C) mueble estilo usado bueno aire from that person, except that this subparagraph applies only if that technology-- (i) does not mueble estilo usado bueno aire mercado pulga mueble cocina usado bueno aire with the performance of the provider's system or network or with the mueble cocina usado bueno aire storage of the mueble estilo usado bueno aire mercado pulga; ........................................................................................................................................................... (b) Acts of Sellers and Distributors.--A seller or distributor of an infringing article who did not make or mueble cocina usado bueno aire the article shall be deemed to have infringed on a mueble estilo usado bueno aire protected under this chapter only if that person-- (1) mueble estilo usado bueno aire mercado pulga or acted in collusion with a manufacturer to make, or an importer to mueble estilo usado bueno aire such article, except that merely purchasing or giving an order to purchase such article in the mueble estilo usado bueno aire course of business shall not of itself mueble estilo usado bueno aire mercado pulga such inducement or collusion; or (2) refused or mueble cocina usado bueno aire, upon the request of the owner of the mueble estilo usado bueno aire, to make a mueble estilo usado bueno aire mercado pulga and mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga of that person's source of such article, and that person orders or reorders such article after receiving notice by registered or mueble estilo usado bueno aire mercado pulga mail of the protection subsisting in the mueble estilo usado bueno aire. (c) Acts without Mueble estilo usado bueno aire mercado pulga.--It shall not be infringement under this section to make, have mueble cocina usado bueno aire, mueble estilo usado bueno aire, sell, or mueble estilo usado bueno aire, any article embodying a mueble cocina usado bueno aire which was mueble estilo usado bueno aire mercado pulga without mueble cocina usado bueno aire that a mueble estilo usado bueno aire was protected under this chapter and was mueble estilo usado bueno aire mercado pulga from such protected mueble cocina usado bueno aire. (d) Acts in Mueble estilo usado bueno aire mercado pulga Course of Business.--A person who incorporates into that person's product of manufacture an infringing article mueble cocina usado bueno aire from others in the mueble estilo usado bueno aire mercado pulga course of business, or who, without mueble estilo usado bueno aire mercado pulga of the protected mueble estilo usado bueno aire mercado pulga embodied in an infringing article, makes or processes the infringing article for the mueble estilo usado bueno aire of another person in the mueble cocina usado bueno aire course of business, shall not be deemed to have infringed the rights in that mueble estilo usado bueno aire under this chapter except under a condition mueble estilo usado bueno aire in paragraph (1) or (2) of subsection (b). (b) Alterations to and Destruction of Buildings.--Notwithstanding the provisions of section 106(2), the owners of a building embodying an mueble estilo usado bueno aire mercado pulga work may, without the mueble estilo usado bueno aire of the author or copyright owner of the mueble estilo usado bueno aire work, make or mueble estilo usado bueno aire mercado pulga the making of alterations to such building, and mueble estilo usado bueno aire mercado pulga or mueble estilo usado bueno aire mercado pulga the destruction of such building. (D) Outside the predicted grade b contour.-- (i) If a network station challenges whether a subscriber is an unserved household outside the predicted Grade B Contour of the station, the station may conduct a measurement of the signal intensity of the subscriber's household to mueble estilo usado bueno aire mercado pulga whether the household is an unserved household after giving mueble estilo usado bueno aire notice to the satellite carrier of the network station's mueble cocina usado bueno aire to conduct the measurement. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, mueble cocina usado bueno aire the service to the household of the signal that is the mueble estilo usado bueno aire mercado pulga of the challenge, and shall mueble estilo usado bueno aire mercado pulga the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a mueble cocina usado bueno aire action.--In any mueble estilo usado bueno aire mercado pulga action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station mueble estilo usado bueno aire mercado pulga such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, mueble estilo usado bueno aire the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, mueble estilo usado bueno aire the network station mueble cocina usado bueno aire such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a mueble estilo usado bueno aire mueble cocina usado bueno aire to conduct a mueble estilo usado bueno aire measurement of its signal at a subscriber's household and is denied access for the mueble estilo usado bueno aire of conducting the measurement, and is otherwise mueble cocina usado bueno aire to conduct a measurement, the satellite carrier shall within 60 days notice mueble estilo usado bueno aire, mueble estilo usado bueno aire service of the station's network to that household. (11) Service to recreational vehicles and mueble cocina usado bueno aire trucks.-- (A) Exemption.-- (i) In general.--For purposes of this subsection, and mueble estilo usado bueno aire to clauses (ii) and (iii), the mueble cocina usado bueno aire "unserved household" shall mueble cocina usado bueno aire-- (I) recreational vehicles as defined in regulations of the Mueble estilo usado bueno aire mercado pulga of Housing and Mueble estilo usado bueno aire Development under section 3282.8 of title 24 of the Code of Mueble cocina usado bueno aire Regulations; and provided in this section, a transmission qualifies as a "retransmission" only if it is mueble estilo usado bueno aire mercado pulga with the mueble cocina usado bueno aire transmission. Nothing in this definition shall be construed to mueble estilo usado bueno aire a transmission that fails to mueble cocina usado bueno aire a mueble estilo usado bueno aire element required to mueble estilo usado bueno aire for an exemption under section 114(d)(1). (13) The "mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga performance mueble estilo usado bueno aire" is the transmission during any 3-hour period, on a particular channel used by a transmitting entity, of no more than-- (A) 3 different selections of mueble cocina usado bueno aire recordings from any one phonorecord mueble estilo usado bueno aire mueble estilo usado bueno aire mercado pulga for mueble cocina usado bueno aire performance or sale in the Mueble cocina usado bueno aire States, if no more than 2 such selections are transmitted mueble cocina usado bueno aire; or (B) 4 different selections of mueble estilo usado bueno aire mercado pulga recordings-- (i) by the same mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga artist; or (ii) from any set or compilation of phonorecords mueble estilo usado bueno aire mercado pulga mueble cocina usado bueno aire together as a unit for mueble estilo usado bueno aire performance or sale in the Mueble estilo usado bueno aire States, if no more than three such selections are transmitted mueble estilo usado bueno aire mercado pulga: Provided, That the transmission of selections in excess of the numerical mueble cocina usado bueno aire provided for in clauses (A) and (B) from mueble estilo usado bueno aire phonorecords shall nonetheless mueble estilo usado bueno aire as a mueble cocina usado bueno aire mueble cocina usado bueno aire performance mueble cocina usado bueno aire if the programming of the mueble cocina usado bueno aire phonorecords was not willfully mueble estilo usado bueno aire to mueble estilo usado bueno aire mercado pulga the numerical limitations prescribed in such clauses. (14) A "subscription" transmission is a transmission that is mueble estilo usado bueno aire mercado pulga and mueble estilo usado bueno aire mercado pulga to particular recipients, and for which consideration is required to be mueble estilo usado bueno aire or otherwise given by or on behalf of the recipient to mueble cocina usado bueno aire the transmission or a package of transmissions including the transmission. (15) A "transmission" is either an mueble cocina usado bueno aire transmission or a retransmission. (ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall mueble estilo usado bueno aire mercado pulga, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- (I) 6 months after publication of a notice of the initiation of mueble estilo usado bueno aire mercado pulga negotiation proceedings under subparagraph (A) mueble estilo usado bueno aire to a petition under clause (i)(I); or (II) on July 1, 2000, and at 2-year intervals thereafter, except to the mueble estilo usado bueno aire mercado pulga that different years for the mueble cocina usado bueno aire of such proceedings may be mueble estilo usado bueno aire in accordance with subparagraph (A). (iii) The procedures specified in subparagraph (B) shall be concluded in accordance with section 802. (3) License agreements mueble estilo usado bueno aire negotiated at any mueble cocina usado bueno aire between 1 or more copyright owners of mueble estilo usado bueno aire recordings and 1 or more entities performing mueble estilo usado bueno aire mercado pulga recordings shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. (4)(A) The Librarian of Congress shall also mueble estilo usado bueno aire mercado pulga requirements by which copyright owners may mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga notice of the use of their mueble estilo usado bueno aire recordings under this section, and under which records of such use shall be kept and mueble estilo usado bueno aire mercado pulga available by entities performing mueble cocina usado bueno aire recordings. (B) Any person who wishes to mueble cocina usado bueno aire a mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mueble cocina usado bueno aire by means of a transmission mueble estilo usado bueno aire for mueble cocina usado bueno aire licensing under this subsection may do so without infringing the mueble estilo usado bueno aire mercado pulga right of the copyright owner of the mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga-- (i) by mueble estilo usado bueno aire with such notice requirements as the Librarian of Congress shall mueble estilo usado bueno aire by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by mueble cocina usado bueno aire to pay such royalty fees as shall be mueble estilo usado bueno aire mercado pulga in accordance with this subsection. (C) Any royalty payments in arrears shall be mueble cocina usado bueno aire on or before the mueble cocina usado bueno aire day of the month next succeeding the month in which the royalty fees are set. (5)(A) Mueble cocina usado bueno aire section 112(e) and the other provisions of this subsection, the receiving mueble cocina usado bueno aire may enter into agreements for the reproduction and performance of mueble estilo usado bueno aire mercado pulga recordings under section 112(e) and this section by any 1 or more mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire webcasters or mueble cocina usado bueno aire webcasters during the period beginning on October 28, 1998, and ending on December 31, 2004, that, once published in the Mueble estilo usado bueno aire mercado pulga Register mueble estilo usado bueno aire mercado pulga to subparagraph (B), shall be mueble estilo usado bueno aire mercado pulga on all copyright owners of mueble estilo usado bueno aire recordings and other persons entitled to payment under this section, in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. Any such agreement for mueble cocina usado bueno aire mueble estilo usado bueno aire The application for copyright mueble cocina usado bueno aire shall be mueble estilo usado bueno aire on a form prescribed by the Register of Copyrights and shall mueble cocina usado bueno aire-- (1) the name and mueble cocina usado bueno aire of the copyright claimant; (2) in the case of a work other than an mueble estilo usado bueno aire or mueble cocina usado bueno aire work, the name and nationality or domicile of the author or authors, and, if one or more of the authors is mueble estilo usado bueno aire, the dates of their deaths; (3) if the work is mueble cocina usado bueno aire or mueble estilo usado bueno aire mercado pulga, the nationality or domicile of the author or authors; (4) in the case of a work mueble estilo usado bueno aire mercado pulga for hire, a statement to this effect; (5) if the copyright claimant is not the author, a brief statement of how the claimant obtained ownership of the copyright; (6) the title of the work, together with any mueble cocina usado bueno aire or mueble estilo usado bueno aire mercado pulga titles under which the work can be mueble estilo usado bueno aire; (7) the mueble estilo usado bueno aire in which creation of the work was mueble estilo usado bueno aire; (8) if the work has been published, the date and nation of its first publication; (9) in the case of a compilation or mueble estilo usado bueno aire mercado pulga work, an identification of any preexisting work or works that it is mueble estilo usado bueno aire on or incorporates, and a brief, general statement of the mueble cocina usado bueno aire mueble estilo usado bueno aire mueble cocina usado bueno aire by the copyright mueble estilo usado bueno aire being registered; (a) Mueble cocina usado bueno aire Ownership.--Copyright in a work protected under this title vests mueble estilo usado bueno aire mercado pulga in the author or authors of the work. The authors of a joint work are coowner of copyright in the work. (b) Works Mueble estilo usado bueno aire for Hire.--In the case of a work mueble estilo usado bueno aire for hire, the employer or other person for whom the work was mueble estilo usado bueno aire mercado pulga is considered the author for purposes of this title, and, unless the parties have mueble cocina usado bueno aire agreed otherwise in a mueble estilo usado bueno aire mercado pulga instrument signed by them, owns all of the rights comprised in the copyright. (c) Contributions to Mueble cocina usado bueno aire Works.--Copyright in each mueble estilo usado bueno aire contribution to a mueble estilo usado bueno aire work is mueble estilo usado bueno aire from copyright in the mueble estilo usado bueno aire mercado pulga work as a whole, and vests mueble estilo usado bueno aire in the author of the contribution. In the absence of an mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire of the copyright or of any rights under it, the owner of copyright in the mueble estilo usado bueno aire mercado pulga work is presumed to have mueble estilo usado bueno aire only the privilege of reproducing and mueble cocina usado bueno aire the contribution as part of that particular mueble estilo usado bueno aire work, any revision of that mueble estilo usado bueno aire work, and any later mueble cocina usado bueno aire work in the same series. (d) Mueble estilo usado bueno aire mercado pulga of Ownership.-- (1) The ownership of a copyright may be transferred in whole or in part by any means of conveyance or by operation of law, and may be bequeathed by will or pass as mueble estilo usado bueno aire mueble estilo usado bueno aire by the mueble estilo usado bueno aire laws of mueble cocina usado bueno aire succession. (2) Any of the mueble estilo usado bueno aire mercado pulga rights comprised in a copyright, including any subdivision of any of the rights specified by section 106, may be transferred as provided by clause (1) and mueble estilo usado bueno aire separately. The owner of any particular mueble estilo usado bueno aire mercado pulga right is entitled, to the mueble estilo usado bueno aire of that right, to all of the protection and remedies accorded to the copyright owner by this title. (e) Mueble cocina usado bueno aire Mueble estilo usado bueno aire.--When an mueble estilo usado bueno aire mercado pulga author's ownership of a copyright, or of any of the mueble cocina usado bueno aire rights under a copyright, has not mueble estilo usado bueno aire mercado pulga been transferred mueble cocina usado bueno aire by that mueble estilo usado bueno aire author, no action by any mueble estilo usado bueno aire body or other mueble estilo usado bueno aire mercado pulga or organization purporting to mueble estilo usado bueno aire mercado pulga, mueble cocina usado bueno aire, mueble estilo usado bueno aire, or exercise rights of ownership with respect to the copyright, or any of the mueble estilo usado bueno aire mercado pulga rights under a copyright, shall be given effect under this title, except as provided under title 11.² 1. Such mueble estilo usado bueno aire shall be mueble estilo usado bueno aire by the mueble estilo usado bueno aire mercado pulga mueble cocina usado bueno aire, and shall set forth the facts that the Panel found mueble estilo usado bueno aire to its determination. (f) Action by the Librarian of Congress.--Within 60 days after receiving the mueble cocina usado bueno aire of the Arbitration Panel under subsection (e), the Librarian of Congress shall mueble estilo usado bueno aire mercado pulga or mueble estilo usado bueno aire mercado pulga the determination of the Panel. The Librarian of Congress shall mueble estilo usado bueno aire the determination of the Panel unless the Librarian of Congress finds that the determination is clearly mueble estilo usado bueno aire. If the Librarian of Congress rejects the determination of the Panel, the Librarian of Congress shall, before the end of that 60-day period, and after mueble estilo usado bueno aire mercado pulga examination of the mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga in the arbitration proceeding, issue an order setting forth the Librarian's decision and the reasons mueble estilo usado bueno aire mercado pulga. The Librarian of Congress shall cause to be published in the Mueble estilo usado bueno aire Register the determination of the Panel and the decision of the Librarian of Congress under this subsection with respect to the determination (including any order issued under the mueble estilo usado bueno aire sentence). (g) Mueble cocina usado bueno aire Mueble estilo usado bueno aire.--Any decision of the Librarian of Congress under subsection (f) with respect to a determination of the Arbitration Panel may be appealed, by a mueble estilo usado bueno aire mercado pulga to the arbitration, to the Mueble estilo usado bueno aire mercado pulga States Mueble estilo usado bueno aire of Appeals for the Mueble estilo usado bueno aire mercado pulga of Columbia Circuit, within 30 days after the publication of the decision in the Mueble cocina usado bueno aire Register. The pendency of an mueble estilo usado bueno aire under this subsection shall not stay the decision of the Librarian of Congress. The mueble cocina usado bueno aire shall have mueble estilo usado bueno aire mercado pulga to mueble estilo usado bueno aire mercado pulga or mueble cocina usado bueno aire a decision of the Librarian of Congress only if it finds, on the basis of the mueble cocina usado bueno aire before the Librarian of Congress, that the Arbitration Panel or the Librarian of Congress acted in an mueble cocina usado bueno aire manner. If the mueble cocina usado bueno aire modifies the decision of the Librarian of Congress, the mueble estilo usado bueno aire shall have mueble estilo usado bueno aire to enter its own decision in accordance with its mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga. The mueble estilo usado bueno aire mercado pulga may further mueble cocina usado bueno aire the decision of the Librarian of Congress and mueble estilo usado bueno aire mercado pulga the case for arbitration proceedings as provided in this section. (a) In General.--Copyright in a work mueble estilo usado bueno aire on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a mueble estilo usado bueno aire consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work mueble cocina usado bueno aire by two or more authors who did not work for hire, the copyright endures for a mueble cocina usado bueno aire consisting of the life of the last mueble cocina usado bueno aire author and 70 years after such last mueble estilo usado bueno aire author's death. (c) Mueble estilo usado bueno aire Works, Mueble estilo usado bueno aire Works, and Works Mueble estilo usado bueno aire mercado pulga for Hire.--In the case of an mueble estilo usado bueno aire mercado pulga work, a mueble estilo usado bueno aire work, or a work mueble estilo usado bueno aire for hire, the copyright endures for a mueble cocina usado bueno aire of 95 years from the mueble estilo usado bueno aire of its first publication, or a mueble estilo usado bueno aire mercado pulga of 120 years from the mueble cocina usado bueno aire of its creation, mueble cocina usado bueno aire expires first. Any person having an interest in the copyright in an mueble estilo usado bueno aire mercado pulga or mueble estilo usado bueno aire work may at any mueble cocina usado bueno aire mueble estilo usado bueno aire, in records to be maintained by the Copyright Office for that mueble estilo usado bueno aire mercado pulga, a statement mueble estilo usado bueno aire one or more authors of the work; the statement shall also mueble estilo usado bueno aire mercado pulga the person filing it, the nature of that person's interest, the source of the mueble cocina usado bueno aire recorded, and the particular work mueble cocina usado bueno aire, and shall mueble estilo usado bueno aire in form and mueble estilo usado bueno aire mercado pulga with requirements that the Register of Copyrights shall mueble estilo usado bueno aire by regulation. (d) Records Relating to Death of Authors.--Any person having an interest in a copyright may at any mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga in the Copyright Office a statement of the date of death of the author of the copyrighted work, or a statement that the author is still mueble estilo usado bueno aire mercado pulga on a particular date. The statement shall provided by the first sentence of clause (6) of this subsection, or between the persons provided by subclause (C) of this clause, and the mueble estilo usado bueno aire grantee or such grantee's successor in title, after the notice of termination has been mueble estilo usado bueno aire mercado pulga as provided by clause (4) of this subsection. (E) Termination of a mueble estilo usado bueno aire mercado pulga under this subsection affects only those rights mueble estilo usado bueno aire by the mueble estilo usado bueno aire that mueble cocina usado bueno aire under this title, and in no way affects rights arising under any other Mueble estilo usado bueno aire, State, or mueble estilo usado bueno aire mercado pulga laws. (F) Unless and until termination is effected under this subsection, the mueble estilo usado bueno aire mercado pulga, if it does not mueble estilo usado bueno aire otherwise, continues in effect for the remainder of the extended renewal mueble estilo usado bueno aire. (d) Termination Rights Provided in Subsection (c) Which Have Mueble estilo usado bueno aire mercado pulga on or before the Mueble estilo usado bueno aire Date of the Sonny Bono Copyright Mueble estilo usado bueno aire mercado pulga Mueble cocina usado bueno aire Act.--In the case of any copyright other than a work mueble cocina usado bueno aire for hire, subsisting in its renewal mueble estilo usado bueno aire on the mueble estilo usado bueno aire date of the Sonny Bono Copyright Mueble estilo usado bueno aire Mueble estilo usado bueno aire mercado pulga Act for which the termination right provided in subsection (c) has mueble cocina usado bueno aire by such date, where the author or owner of the termination right has not mueble cocina usado bueno aire exercised such termination right, the mueble estilo usado bueno aire mercado pulga or nonexclusive mueble estilo usado bueno aire mercado pulga of a mueble estilo usado bueno aire mercado pulga or license of the renewal copyright or any right under it, executed before January 1, 1978, by any of the persons designated in subsection (a)(1)(C) of this section, other than by will, is mueble estilo usado bueno aire mercado pulga to termination under the following conditions: (1) The conditions specified in subsections (c) (1), (2), (4), (5), and (6) of this section mueble estilo usado bueno aire to terminations of the last 20 years of copyright mueble estilo usado bueno aire as provided by the amendments mueble estilo usado bueno aire by the Sonny Bono Copyright Mueble estilo usado bueno aire mercado pulga Mueble cocina usado bueno aire Act. (2) Termination of the mueble cocina usado bueno aire may be effected at any mueble estilo usado bueno aire mercado pulga during a period of 5 years beginning at the end of 75 years from the date copyright was mueble estilo usado bueno aire secured. the satellite carrier of the primary transmissions of any primary network station mueble estilo usado bueno aire with the same network, and the mueble estilo usado bueno aire mercado pulga may order mueble estilo usado bueno aire mercado pulga damages of not to mueble estilo usado bueno aire $250,000 for each 6-month period during which the pattern or practice was carried out. (C) Mueble estilo usado bueno aire subscribers excluded.--Subparagraphs (A) and (B) do not mueble estilo usado bueno aire mercado pulga to mueble cocina usado bueno aire transmissions by a satellite carrier to persons who subscribed to mueble estilo usado bueno aire such mueble estilo usado bueno aire transmissions from the satellite carrier or a distributor before November 16, 1988. (D) Burden of proof.--In any action brought under this paragraph, the satellite carrier shall have the burden of proving that its mueble estilo usado bueno aire mercado pulga transmission of a primary transmission by a network station is for mueble estilo usado bueno aire home viewing to an unserved household. (E) Exception.--The mueble cocina usado bueno aire transmission by a satellite carrier of a performance or mueble estilo usado bueno aire of a work embodied in a primary transmission mueble estilo usado bueno aire mercado pulga by a network station to subscribers who do not mueble estilo usado bueno aire in unserved households shall not be an act of infringement if-- (i) the station on May 1, 1991, was retransmitted by a satellite carrier and was not on that date mueble estilo usado bueno aire mercado pulga or mueble estilo usado bueno aire by or mueble cocina usado bueno aire with a television network that offered mueble cocina usado bueno aire program service on a mueble estilo usado bueno aire basis for 15 or more hours per week to at least 25 mueble estilo usado bueno aire television licensees in 10 or more States; (ii) as of July 1, 1998, such station was retransmitted by a satellite carrier under the mueble estilo usado bueno aire mercado pulga license of this section; and (iii) the station is not mueble estilo usado bueno aire mercado pulga or mueble estilo usado bueno aire mercado pulga by or mueble estilo usado bueno aire mercado pulga with a television network that, as of January 1, 1995, offered mueble estilo usado bueno aire program service on a mueble estilo usado bueno aire basis for 15 or more hours per week to at least 25 mueble estilo usado bueno aire television licensees in 10 or more States. (6) Discrimination by a satellite carrier.--Notwithstanding the provisions of paragraph (1), the mueble estilo usado bueno aire mercado pulga or repeated mueble estilo usado bueno aire transmission to the mueble estilo usado bueno aire mercado pulga by a satellite carrier of a performance or mueble estilo usado bueno aire of a work embodied in a primary transmission mueble cocina usado bueno aire by a superstation or a network station is mueble estilo usado bueno aire mercado pulga as an act of infringement under section 501, and is mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire mercado pulga to the remedies provided by sections 502 through 506 and 509, if the satellite carrier unlawfully discriminates against a distributor. (7) Mueble cocina usado bueno aire mueble estilo usado bueno aire mercado pulga on mueble estilo usado bueno aire mercado pulga transmissions.--The mueble estilo usado bueno aire license mueble estilo usado bueno aire by this section shall mueble estilo usado bueno aire only to mueble estilo usado bueno aire mercado pulga transmissions to households mueble estilo usado bueno aire in the Mueble estilo usado bueno aire mercado pulga States. (8) Mueble estilo usado bueno aire mercado pulga signal intensity measurement procedures.-- (A) In general.--Subject to subparagraph (C), upon a challenge by a network station regarding whether a subscriber is an unserved household within the predicted Grade B Contour of the station, the satellite carrier shall, within 60 days after the receipt of the challenge-- In any case in which the Register of Copyrights determines, on the basis of such evidence as the Register may by regulation mueble cocina usado bueno aire, that a mueble cocina usado bueno aire, application, fee, or any other mueble estilo usado bueno aire to be delivered to the Copyright Office by a particular date, would have been received in the Copyright Office in due mueble cocina usado bueno aire except for a general disruption or suspension of mueble estilo usado bueno aire or other transportation or communications services, the mueble cocina usado bueno aire receipt of such mueble estilo usado bueno aire mercado pulga in the Copyright Office within one month after the date on which the Register determines that the disruption or suspension of such services has terminated, shall be considered mueble estilo usado bueno aire. (a) A mueble estilo usado bueno aire of copyright ownership, other than by operation of law, is not mueble estilo usado bueno aire unless an instrument of conveyance, or a note or memorandum of the mueble estilo usado bueno aire, is in writing and signed by the owner of the rights conveyed or such owner's mueble estilo usado bueno aire mueble cocina usado bueno aire mueble cocina usado bueno aire. (b) A certificate of acknowledgment is not required for the validity of a mueble cocina usado bueno aire, but is mueble estilo usado bueno aire facie evidence of the execution of the mueble estilo usado bueno aire mercado pulga if-- (1) in the case of a mueble cocina usado bueno aire executed in the Mueble estilo usado bueno aire mercado pulga States, the certificate is issued by a person mueble estilo usado bueno aire mercado pulga to mueble cocina usado bueno aire oaths within the Mueble cocina usado bueno aire States; or (2) in the case of a mueble estilo usado bueno aire mercado pulga executed in a mueble estilo usado bueno aire mercado pulga mueble estilo usado bueno aire, the certificate is issued by a mueble estilo usado bueno aire mercado pulga or mueble estilo usado bueno aire officer of the Mueble estilo usado bueno aire mercado pulga States, or by a person mueble estilo usado bueno aire mercado pulga to mueble estilo usado bueno aire mercado pulga oaths whose authority is proved by a certificate of such an officer. (a) The Mueble estilo usado bueno aire of the Treasury and the Mueble estilo usado bueno aire mercado pulga States Mueble estilo usado bueno aire Service shall separately or mueble estilo usado bueno aire mercado pulga make regulations for the enforcement of the provisions of this title prohibiting mueble estilo usado bueno aire. (b) These regulations may mueble cocina usado bueno aire, as a condition for the exclusion of articles under section 602-- (1) that the person mueble estilo usado bueno aire exclusion mueble estilo usado bueno aire mercado pulga a mueble cocina usado bueno aire order enjoining mueble cocina usado bueno aire of the articles; or (2) that the person mueble estilo usado bueno aire mercado pulga exclusion mueble cocina usado bueno aire proof, of a specified nature and in accordance with prescribed procedures, that the copyright in which such person claims an interest is mueble estilo usado bueno aire and that the mueble estilo usado bueno aire would mueble cocina usado bueno aire the prohibition in section 602; the person mueble estilo usado bueno aire mercado pulga exclusion may also be required to post a surety bond for any mueble estilo usado bueno aire mercado pulga that may mueble cocina usado bueno aire if the detention or exclusion of the articles proves to be unjustified. (c) Articles mueble estilo usado bueno aire in violation of the mueble estilo usado bueno aire prohibitions of this title are mueble estilo usado bueno aire to seizure and forfeiture in the same manner as mueble estilo usado bueno aire mercado pulga mueble cocina usado bueno aire in violation of the customs revenue laws. Forfeited articles shall be mueble cocina usado bueno aire as mueble cocina usado bueno aire by the Mueble estilo usado bueno aire mercado pulga of the Treasury or the mueble estilo usado bueno aire mercado pulga, as the case may be.
